I suppose it may depend on what your nephew did to provoke it, but in 99% of scenarios, a slap from an un-related adult would have provoked me into an immediate and bone breaking attack. But I can be a bit primitive at times. Litigation may be the way to go, but I have to override blood instinct first.

I said 99%, and that falls well within the 99%. I probably would have broken several of his bones, Bosnian or not. There was no excuse for him to even confront your nephew there, let alone touch him. If he hasn't already gotten citizenship, Immigration and Naturalization might need a call.
